Divorce Overview When a marriage comes to an end the law requires spouses to address important issues related to their property and their children. Parties may do this by agreement or by submitting the issues to a judge for a decision. In both cases, we believe that a successful divorce is one where the clients go into and come out of the process prepared to move on with their lives. We strive to help our clients preserve their finances and protect the relationship with their children. In a divorce, the issues are generally the division of marital property and the custody, visitation and child support for the children. A divorce may also involve claims for support alimony depending on the circumstances. When the parties are unable to agree this is called a contested divorce. A contested divorce can be lengthly, costly and extremely stressful. When the parties are able to agree they can by-pass much of the stress and length of a contested divorce. We call this a uncontested divorce. It is also known as an agreed divorce or waiver divorce. Attorney fees in Divorce Cases We handle the vast majority of our divorce cases on a hourly basis. This means that you pay for attorney time devoted to your case. Certain agreed or uncontested divorce cases are handled on a flat fee basis.
