Uncontested or Agreed Divorce If you and your spouse have come to the decision that you marriage is ending and you both agree on the terms of your divorce, you have done much of the hardwork already. You should consider that you have achieved a great success. You also have a good foundation for an uncontested or agreed divorce. The process is much simplier than a contested divorce. Nonetheless, there are still a few steps to go through in order to successful complete the process. In our office, we start with a consultation with one of the spouses. The law and our ethical rules prevent us from representing both spouses. We then prepare and file a petition for divorce with the court. Once the divorce is on file we draft the Decree of Divorce based on the parties agreement. Once completed the parties will review the decree and sign it. The last step in the process is when the agreed order is presented to the judge for approval. At this point the divorce is complete. By law, parties with children must generally take a parenting class and wait ninety (90) days before the judge can grant their divorce. Some counties require the parenting class, others do not. Cleveland County requires that each parent complete a parenting class: Court rules also ask that parties without children to wait ten (10) days before presenting a final order for the judge's approval.
